Terms and Conditions.

Copyright.

The copyright for all images remains with the photographer. This remains the case for all images captured by me, including where I have been commissioned by you, you have bought the right (licence) to print your own photographs and where the photographs were taken on your private land. You will be asked to sign a model release form to this effect prior to any pictures being taken. The licence to use an image does not come into effect until the entire bill has been paid in full. Use of and/or printing, publication, whether printed or electronic form is prohibited until the licence comes into effect. Legal action may be taken against anyone who uses my copyrighted images without the proper licence. Images used without permission will be charged at the rate of £15 per image per day.


Deposit.

The deposit is due at the time of booking. This may, in certain circumstances , be delayed but in any case, the deposit must be paid before any shoot can take place. If someone else wishes to book the slot you want, but you have not paid the deposit, you will be given a short period of time to pay the deposit. If the deposit isn’t paid within this time, the slot will be deemed to have been released by you and I will let the other party book that slot. Once paid, your deposit will guarantee that slot which cannot then be booked by anyone else.

I operate a “best practice” policy. If you need to cancel, for any reason, half the deposit paid (as long as expenses are covered) will be returned to you. I will then endeavour to fill that particular day/time with another customer. If this happens, I will refund the remainder of the deposit. If I can’t fill the slot, the rest of the deposit is non refundable. Obviously, the earlier you let me know, the more chance I have of re-booking the slot. This principle will also apply in the event of a postponement of the shoot. In the event of the original date cannot be rebooked, the deposit will be forfeited by the customer and a further deposit required for the new date.


Post Shoot Orders.

As any image order, (print, photo gift, DVD etc) is only applicable to and specific to you, all orders are special orders. Once placed, special orders CANNOT be cancelled. Payment in full is required even if you change your mind and decide not to take the photos, products etc.


Payment.

Payment can be made via cash, credit or debit cards & cheques. Cheques will have to clear before I commit to the order. Please be aware that this method of payment will add around a week to the delivery time for this reason.


Nude Portraits.

I am happy to take nude photographs of anyone over the age of eighteen. Proof of age will be required. The ONLY proof of age ID permissible, is either a passport or driving licence that includes a photograph. You MUST provide BOTH parts of the driving licence. NO other form of ID is acceptable. There are no exceptions to this. If suitable proof of age ID isn’t available, no nude photography can take place. The client will be liable for all costs incurred in the event of cancellation of a studio etc due to appropriate ID not being available. In this instance, the whole quoted amount for the shoot will become payable.


Log in.

Your log in is unique to your event. I will only give this log in to you. If there is someone who you do not wish to order prints etc of your event, do not give them the log in or password. It is up to you to ensure that they aren’t given the log in and password for your event. If you forget your log in password, please contact me in writing and I will supply the password to the authorised recipients.


Warranty.

All goods, key rings, prints, electrical goods etc will be checked prior to collection/delivery. Electrical goods have a 12 month guarantee. If a fault develops within this time, please contact me. Faults due to wear and tear, modification, accident, civil unrest, theft or improper use are not covered by any guarantee. Photographic prints are printed using dye sublimation inks which are resistant to fading under normal circumstances.

By placing an order, you have agreed to be bound by these terms and conditions. Your statutory rights are not affected.


Archival: The digital negatives / files will be archived for a minimum of 5 years after the date of the wedding. After this time, the photographer reserves the right to permanently delete and destroy these files. If you wish to purchase them, contact the photographer who will let you know the price to do this. Alternatively, you can request that the files be archived for a further length of time, in yearly increments. There is a cost to do this which will be given at the time of request.


Exclusivity: In order for the client to receive the best service possible, the photographer must be the exclusive professional wedding photographer for the wedding. Additional professional photographers may be employed with written permission from the photographer. Guest photographers (amateurs) are obviously welcome but with one caveat; The photographer will request intervention if a guest or guests is/are inhibiting the ability of the photographer to document your wedding.


Limits Of Liability: While every reasonable effort will be made to produce and deliver the best possible photographs of the wedding events, the entire liability of the photographer to the client for any claim or loss arising from my performance is limited to a refund to the client of the amount paid for services. Because a wedding is an un-controlled event, the photographer cannot guarantee delivery of any specifically requested image(s).
